By accessing or using Menubar ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

Menubar provides a website builder platform for restaurants, home chefs, and food businesses to create their online presence and manage orders.

2. Eligibility

To use Menubar, you must:

• Be at least 18 years old or the age of majority in your jurisdiction
• Have the legal authority to enter into this agreement
• Operate a legitimate food business or be in the process of starting one
• Comply with all applicable local, state, and national laws regarding food service and business operations

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

• Provide accurate and complete information during registration
• Keep your account information up to date
• Notify us immediately of any unauthorized access to your account
• Not share your account credentials with others

4. Acceptable Use

You agree to use Menubar only for lawful purposes. You shall not:

• Upload false, misleading, or fraudulent content about your business or menu
• Misrepresent the nature, ingredients, or origin of your food items
• Use the Service to sell illegal or prohibited items
• Infringe on the intellectual property rights of others
• Upload malicious code or attempt to compromise the security of our platform
• Use the Service in any way that could damage, disable, or impair our systems
• Collect or harvest user data without authorization

5. Your Content

You retain ownership of all content you upload to Menubar, including text, images, menus, and business information ("Your Content"). By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute Your Content solely for the purpose of providing and promoting the Service.

You are solely responsible for Your Content and represent that you have all necessary rights to upload and share it. We do not endorse or verify the accuracy of user-uploaded content.

6. Orders and Transactions

Menubar facilitates connections between you and your customers but is not a party to transactions between you and your customers. You are solely responsible for:

• The quality, safety, and legality of your food products
• Accurate pricing and menu information
• Fulfilling orders in a timely manner
• Handling customer complaints and refunds
• Compliance with food safety regulations and licensing requirements
• Collecting and remitting applicable taxes

7. Fees and Payment

Menubar offers different subscription plans with varying features. By subscribing to a paid plan, you agree to pay the applicable fees. We may change our fees with 30 days' notice.

We do not charge commissions on orders placed through your website. You keep 100% of your order revenue.

8. Intellectual Property

The Menubar platform, including its design, features, code, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of our platform without our written permission.

9. Termination

You may cancel your account at any time through your account settings or by contacting us. We may suspend or terminate your account if you violate these Terms or for any other reason with reasonable notice.

Upon termination, your website will be taken offline and your data will be deleted in accordance with our Privacy Policy.

10. Disclaimer of Warranties

Menubar is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure. We are not responsible for any losses resulting from your use of the Service or reliance on information provided through it.

11. Limitation of Liability

To the maximum extent permitted by law, Menubar and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Menubar, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in Bangalore, India.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of Menubar after changes constitutes acceptance of the modified Terms.
